Current Litigation

On July 1, 2016, Silvia Burley filed suit against the Federal government in an attempt to stop the organization of the Tribe under the Washburn Determination of December 2015. The Community, in the name of the Tribe, joined the suit on the side of the government. On May 30, 2017 there was a Hearing; and on June 1, 2017 the Court rendered its Decision, denying Burley's claims, granting the government's and our Tribe's motion to dismiss and upholding as legal the 2015 Determination of the BIA to organize the Tribe. Silvia Burley (in the name of the Tribe) versus Everone. During the dispute over tribal authority, on September 18, 2015, Silvia Burley sued both the California Gambling Control Commission and Chadd Everone (the Tribe's Deputy and Consul General) for conspiracy and interference with her business opportunity. Everone, on behalf of himself, countered sued with an anti-SLAPP Motion. In February 2017, the Court issued its Notice of Judgment saying that all of the activities by Everone on behalf of the Tribe were "protected activities". Thus, all of Burley's accusations against Everone are groundless. That would also apply to other members of the Tribe, government officials, and anyone who seemed to get in the way of her ambitions. Also, fees of $21,000 were awarded to Everone.
